Terms of Service

1. Acceptance of Terms

By accessing or using ibocompare.com (“the Service”), you agree to comply with these Terms of Use (“TOU”). If you object to any term, your only recourse is to immediately discontinue use of the Service.

2. Membership, Billing, and Cancellations

Subscription: Membership fees are billed annually via Stripe. By providing payment information, you authorize recurring annual charges.

Cancellations: You can cancel at any time. Upon cancellation, your listing remains active and you retain all membership benefits until the end of your current annual billing cycle. No pro-rated refunds are issued for partial terms.

Modifications: We reserve the right to modify these terms at any time. Changes are effective immediately upon posting.

3. Third-Party Content and Services

The Service contains links to independent third-party websites and businesses. IBO Compare does not guarantee the quality, safety, or accuracy of any third-party content. Your interactions with these parties, including payment and delivery of services, are solely between you and them. You should conduct your own due diligence before any transaction.

4. Proprietary Rights and Intellectual Property

The Service, including its layout, code, and content, is protected by copyright and trademark laws. You cannot reproduce, reverse engineer, or scrape content without express written permission. Unauthorized use might result in liquidated damages as outlined in Section 5.

5. Prohibited Conduct and Liquidated Damages

No Spam: Sending unsolicited email advertisements to our systems is prohibited. You agree to pay $100 per email as liquidated damages for violations.

No Scraping: Aggregating, copying, or duplicating our content without permission is prohibited. You agree to pay $5,000 per day for each day of such conduct.

6. Disclaimer of Warranties and Limitation of Liability

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. To the fullest extent permitted by law, IBO Compare disclaims all warranties. In no event will IBO Compare’s total liability exceed the sum of $1.00. IBO Compare is not a party to any agreement between users and third-party businesses listed on the site.

7. Disputes and Governing Law

Any claim arising out of these TOU must be filed within one (1) year after the cause of action arose or be forever barred. In the event of a dispute, you release IBO Compare, its officers, and employees from all claims and damages.

8. Notification of Claims of Infringement

If you believe your intellectual property has been infringed, please send a notice to: [email protected], including the specific material, your contact information, and a statement of good faith under penalty of perjury.
